MIAMI – A Walmart employee alleges her insurer wrongfully denied her claim for long-term disability benefits.
LaNoir Washington filed a complaint on Feb. 13 in the U.S. District Court for the Southern District of Florida against Liberty Life Assurance Co. of Boston alleging violation of Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled and applied for long-term disability benefits but her claim was denied. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly denied plaintiff's claim for benefits, failed to properly and adequately investigate the merits of plaintiff's disability claim, and failed to provide a full and fair review of plaintiff's claim.
The plaintiff seeks judgment against defendant, payment of disability benefits due, costs, attorneys’ fees, interest and further relief as the court deems just. She is represented by Stephen F. Jessup of Attorneys Dell and Schaefer Chartered in Hollywood.
