Driver seeks underinsured/uninsured motorist benefits from Progressive American Insurance

KISSIMMEE – An Osceola County woman alleges her insurer breached its duties when she filed a claim for uninsured/underinsured motorist benefits.

Brenda Marcelle Becker filed a complaint on Feb. 23 in 9th Judicial Circuit Court of Florida - Osceola County against Progressive American Insurance Co. citing uninsured motorist benefits.

According to the complaint, the plaintiff alleges that on Jan. 23, 2014, while operating her motor vehicle, an uninsured/underinsured driver collided with her vehicle in Osceola County. She alleges she suffered physical injuries, loss of wages and incurred medical expenses. Plaintiff filed appropriate claims for her uninsured motorist benefits in accordance with the terms of her policy, the suit states. The plaintiff holds Progressive American Insurance Co. responsible because the defendant allegedly failed to settle plaintiff's uninsured motorist claim, placed its own financial interest before that of plaintiff's and failed to acknowledge and failed to adopt and implement standards for the proper investigation of claims.

The plaintiff requests a trial by jury and seeks award for total damages, pre- and post-judgment interest, attorney's fees, costs and any other relief the court deems proper and just. She is represented by Travis J. McMillen of Bogin, Munns and Munns PA in Orlando.
