Woman alleges Union Security Insurance breached contract during appeal process for benefits

PENSACOLA – A Minnesota woman alleges that no determination has been made on her appeal for the termination of her disability benefits.

Cheryl L. Howard filed a complaint on Jan. 23 in the U.S. District Court for the Northern District of Florida, Pensacola Division against Union Security Insurance Co. alleging violation of the Employee Retirement Income Security Act and breach of contract.

According to the complaint, the plaintiff alleges that in 2014, she became disabled due to kidney disease and other medial ailments and applied for disability benefits. The suit states the benefits were initially approved until her claim was terminated in 2016. The plaintiff appealed the decision and the defendant has requested three extensions for a review, but no determination has been reached, the suit states.

The plaintiff seeks all benefits owing to the plaintiff, interest, all legal fees, and any other relief as the court deems just. She is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
