Southwest Credit Systems LP alleged to have invaded man's privacy with collection calls

FORT LAUDERDALE – A Texas debt collector is accused of invading a consumer's privacy with its calls.

Fekel Exantus filed a complaint on Jan. 19 in the U.S. District Court for the Southern District of Florida against Southwest Credit Systems LP citing the Telephone Consumer Protection Act, the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he suffered damages from receiving several collection calls from the defendant. The plaintiff holds Southwest Credit Systems LP responsible because the defendant allegedly kept on calling plaintiff using an automatic telephone dialing system for a disputed debt and invaded his privacy.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each negligent violation and $1,500 for each knowing violation, enjoin the defendant from calling his phone, and any other relief as the court deems just. He is represented by George N. Andrews of Loan Lawyers LLC in Fort Lauderdale.
