Former employee alleges All American Waste & Recycling did not pay minimum wage

MIAMI – A Miami-Dade County man alleges he was not paid a minimum wage or overtime during his employment as a driver.

Enrique Arrieta Solana filed a complaint on Feb. 14 in the U.S. District Court for the Southern District of Florida against All American Waste & Recycling LLC and Alexander Monteagudo citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked as a driver from December 2014 to October 2016. The plaintiff holds All American Waste & Recycling LLC and Monteagudo responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for hours worked that exceeds 40 and did not pay him a minimum wage. He also alleges that he was promised a title and possession of a work truck in exchange for $21,000 deducted from his check, but the defendants have failed and refused to tender the title.

The plaintiff requests a trial by jury and seeks all damages, interest, all legal fees and any other relief as the court deems just. He is represented by Brian H. Pollock of Fairlaw Firm in Miami.
