Man alleges Dynasty Landscaping Service did not pay overtime rate for extra hours worked

MIAMI – A Miami-Dade County man alleges he was not paid overtime wages during his employment with a tree trimming company.

Ernesto Pavoni filed a complaint on behalf of all others similarly situated on Feb. 14 in the U.S. District Court for the Southern District of Florida, Miami Division against Dynasty Landscaping Service Inc., doing business as Dynasty Tree Service and formerly known as Economic Tree Service Corp. and Economic Tree Trimming Corp., and Jose Molina citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week as a tree trimmer and stump grinder during his employment from July 2016 to January. The plaintiff holds Dynasty Landscaping Service Inc. and Molina responsible because the defendants allegedly failed to pay the proper overtime rate to the plaintiff of one-and-one-half the regular rate of pay.

The plaintiff requests a trial by jury and seeks compensatory and liquidated damages, all legal fees, interest, and any other relief as the court deems just. He is represented by Daniel T.
