Woman claims debt collector filed suit in different county to coerce her into paying alleged debt

MIAMI – A Broward County consumer alleges a debt collector violated federal law when it filed a suit against her in a county in which she does not reside.

Brenda McAllister filed a complaint on Feb. 17 in the U.S. District Court for the Southern District of Florida against Superior Capital LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in January, she suffered damages from having a court case filed against her for an alleged debt in Miami-Dade County. The plaintiff holds Superior Capital LLC responsible because the defendant allegedly filed a state court action against the plaintiff in a different county in order to coerce her into satisfying her disputed debt.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, all legal fees and any other relief as this court deems just. She is represented by Joel D. Lucoff of Debt Rescue Clinic in Miami.
