FORT LAUDERDALE – A Broward County man alleges his employer terminated him because of an on-the-job injury.
Roberto Cabrera filed a complaint on behalf of other similarly situated individuals on Feb. 16 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Paramount Property Maintenance LLC, Rafael A. Cadena and Humberto Castelan alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week during his employment with the defendants. The plaintiff holds Paramount Property Maintenance LLC, Cadena and Castelan responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week. He also alleges that he was injured at work in June 2016, which led to his termination in January.
The plaintiff requests a trial by jury and seeks actual damages, all back wages, all other damages, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
