Clearwater woman says Avmed misclassified her status as exempt

TAMPA — A Clearwater woman has filed a class-action lawsuit against her former employer, citing alleged unpaid wages and violation of workers' compensation acts.

Christie Stone filed a complaint on behalf of all others similarly situated on Feb. 8 in the U.S. District Court for the Middle District of Florida against Avmed Inc. alleging that the company failed to pay fair wages to the plaintiff for her work.

According to the complaint, the plaintiff alleges that she worked as a sales representative for more than 40 per week hours without being paid any overtime compensation because she was classified as exempt. Due to her responsibilities, she should be considered nonexempt, the complaint states. The plaintiff holds Avmed responsible because the defendant allegedly failed to pay her any overtime premium for working more than 40 hours.

The plaintiff requests a trial by jury and seeks enjoin the defendant, all wages, liquidated damages, interest, all legal fees and any other relief as this court deems just. She is represented by Mitchell L. Feldman of Mitchell L. Feldman, Esq. P.A. in Tampa.
