MIAMI – A Volusia County woman has filed suit seeking short and long-term disability benefits she alleges she is entitled to.
Jessica Wahl filed a complaint on Feb. 9 in the U.S. District Court for the Southern District of Florida, Miami Division against Mutual of Omaha Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled and applied for disability benefits, which were approved but then terminated. The plaintiff holds Mutual of Omaha Insurance Co. responsible because the defendant allegedly refused to pay short and long-term disability benefits to the plaintiff despite having sufficient medical records to prove her disabilities.
The plaintiff seeks unpaid short-term and long-term disability benefits plus interest, all legal fees and any other relief as the court deems just. She is represented by Susan B. Grabarsky and Frank N. Darras of Darras Law in Ontario, California and Edward Philip Dabdoub and Carter Meader of Wagar Dabdoub PA in Coral Gables.
