MIAMI – A former employee of a Miami-Dade County business alleges he was not paid a minimum wage.
Diego Fernando Perez Solarte filed a complaint on behalf of all others similarly situated on Feb. 9 in the U.S. District Court for the Southern District of Florida against Georgio's Bakery Market Inc., also known as Georgios Bakery & Bistro, and Peter Tsialiamanis citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week but was only paid an average of $5 an hour. The plaintiff holds Georgio's Bakery Market Inc. and Tsialiamanis responsible because the defendants allegedly refused to pay wages to the plaintiff plus overtime wages at a rate of time-and-one-half of his regular rate and also failed to pay a minimum wage.
The plaintiff requests a trial by jury and seeks double damages, all overtime and minimum wages still owing, all legal fees and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell, P.A. in Miami Beach.
