Sandwich Depot Cafe did not pay correct overtime wages, former employee claims

GAINESVILLE – A former employee for an Alachua County restaurant claims his pay was changed for his final paycheck.

Peter Sassano filed a complaint on Feb. 3 in the U.S. District Court for the Northern District of Florida, Gainesville Division against the Daniela Mylot and The Sandwich Depot Cafe LLC citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he left his job in November 2016 but his pay was retroactively cut for final paycheck. The plaintiff holds Mylot and The Sandwich Depot Cafe LLC responsible because the defendants allegedly cut his regular rate from $9.75 to $8.05 and did not pay time-and-one-half for the overtime hours he worked.

The plaintiff seeks payment of all overtime hours, liquidated damages all legal fees and any other relief as the court deems just. He is represented by Michael Massey of Massey & Duffy in Gainesville.
