Ultimate Towing of Gainesville Inc. driver alleges he is owed unpaid overtime

GAINESVILLE – A tow truck driver for an Alachua County business he was not properly compensated for overtime work.

Justin McClain filed a complaint on Jan. 26 in the U.S. District Court for the Northern District of Florida, Gainesville Division against Ultimate Towing of Gainesville Inc. and Stephen J. O'Grady alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours a week without being paid any overtime compensation. The plaintiff holds Ultimate Towing of Gainesville Inc. and Stephen J. O'Grady responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week.

The plaintiff seeks all overtime wages, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Michael Massey of Massey & Duffy in Gainesville.
