Law money 06

WEST PALM BEACH – A dispatcher alleges his employer misclassified him as exempt from receiving overtime.

David Dechert filed a complaint on behalf of other similarly situated on Feb. 1 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against Interstate Distributor Co. and Scott Dudley citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Interstate Distributor Co. and Dudley responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks damages, unpaid overtime compensation, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Jay P. Lechner and Jason M. Melton of Whittel & Melton LLC in St. Petersburg.
