Woman alleges insurer subjected her to unreasonable disability benefits claim process

ORLANDO – A woman alleges her claim for disability benefits was unlawfully denied.

Kowsilia Bhagratie filed a complaint on Jan. 23 in the U.S. District Court for the Middle District of Florida against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was subjected to unreasonable claims process and eventually suffered damages as a result of defendant's denial of her long-term disability benefits. The plaintiff holds Life Insurance Co. of North America responsible because the plaintiff alleges she is disabled according to the terms of the plan.

The plaintiff requests a trial by jury and seeks judgment against defendant, declaratory relief, reinstatement of benefits, interest, costs, attorney's fees, and other relief as the court may deem appropriate. She is represented by William S. Coffman Jr. of Coffman Law in Tampa.
