Far East Cafe delivery driver claims he is owed unpaid wages

MIAMI – A driver for a Chinese restaurant alleges he is not paid a minimum wage.

Nelson I. Santos filed a complaint on behalf of other similarly situated individuals on Jan. 27 in the U.S. District Court for the Southern District of Florida, Miami Division against Wong Chong's Happy Days Restaurant Inc., doing business as Far East Cafe; Kam Siu De-Wong; and Wai L. Wong citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid minimum wage or overtime wage. The plaintiff holds Wong Chong's Happy Days Restaurant Inc., doing business as Far East Cafe; De-Wong; and Wong responsible because the defendants allegedly failed to properly compensate the plaintiff and misclassified him as an independent contractor.

The plaintiff requests a trial by jury and seeks actual damages, unpaid overtime compensation, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Zandro E. Palma of Zandro E. Palma, P.A. in Miami.
