MIAMI – A former human resources manager for The Home Depot alleges her long-term disability benefits were wrongfully terminated despite her still being disabled according to the terms of the plan.
Linda Andersen filed a complaint on Jan. 27 in the U.S. District Court for the Southern District of Florida. Miami Division against Aetna Life Insurance Co. citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in November 2013, she discontinued to work due to her disability and was initially approved to receive disability benefits until the benefits were terminated in 2015. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly upheld their decision to deny plaintiff's disability benefits despite having sufficient medical evidence.
The plaintiff seeks unpaid long-term disability benefits plus interest, all legal fees and any other relief as the court deems just. She is represented by Edward Philip Dabdoub, Carter Meader and Geannina Burgos of Wagar Dabdoub PA in Coral Gables.
