U.S.A. Plumbing & Septic Inc. alleged to have not paid overtime rate for extra hours

MIAMI – A Miami-Dade County plumbing business is accused of not properly compensating its employees for overtime wages.

Yoel Molina filed a complaint on behalf of all others similarly situated on Jan. 26 in the U.S. District Court for the Southern District of Florida against U.S.A. Plumbing & Septic Inc. and Antonio L. Garcia citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week as a septic and plumbing worker without being paid any overtime compensation. He alleges he worked 732.5 of overtime hours from January to December 2016 and was not paid at a rate of time-and-one-half for those hours.

The plaintiff requests a trial by jury and seeks double damages, all overtime wages still owing, all legal fees and any other relief as this court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
