Former Scarfone's Coal Fired Pizza, Big Rooster's Southern Table employees allege wage law violations

MIAMI – Two former cooks allege their former employers did not pay overtime wages.

Griselda Perales and Fidel Lopez filed a complaint on Jan. 9 in the U.S. District Court for the Southern District of Florida against Scarfone's of Wilton Manors Inc.; The Pizza and Pasta Factory Inc. doing busines as Scarfone's Coal Fired Pizza; Big Rooster's Southern Table LLC; Daniel Scarfone; Daniel Scarfone Jr.; and Angela Ruth Speros citing the Fair Labor Standards Act and the Florida Minimum Wage Amendment.

According to the complaint, the plaintiffs allege that they suffered economic losses from not receiving adequate overtime wages for all hours worked beyond 40 hours in a week. Lopez also alleges that he did not receive wages for his last week of employment. The plaintiffs holds the defendants responsible because the defendants allegedly failed to pay plaintiffs at or above the minimum wage, failed to properly apprise its employees of their rights under the FLSA, and failed to compensate its employees of overtime wages.

The plaintiffs request a trial by jury and seek judgment against defendants, declaratory relief, back wages, liquidated damages, attorney's fees, costs, expenses, interest, $1,000 per violation, and further relief the court deems just. They are represented by Peter J. Bober and Samara Robbins Bober of Bober & Bober PA in Hollywood.
