Rosalia's employees allege they were not compensated for overtime work

MIAMI – Three former members of restaurant's waiting staff claim they were not paid for overtime hours worked.

Jaime Augusto Roncancio, Cesar Augusto Vargas Gonzalez and Armando Trinidad Cano Miranda filed a complaint on behalf of all others similarly situated on Jan. 25 in the U.S. District Court for the Southern District of Florida against Rosalia's Inc. and Manuel Paucar citing the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without being paid any overtime wages. The plaintiffs holds Rosalia's Inc. and Paucar responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half to the plaintiffs for the hours worked that exceeded 40.

The plaintiffs request a trial by jury and seek compensatory and liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Daniel T. Feld of Law Office of Daniel T. Feld P.A. in Hollywood and Isaac Mamane of Mamane Law LLC in Bay Harbor Islands.
