Brazilian man alleges ex-wife took children to Orlando without consent, overstayed visas

ORLANDO — A Brazilian man living is suing his former spouse who is in Orlando, citing alleged wrongful removal and retention of their children.

The man filed a complaint in the U.S. District Court for the Middle District of Florida Orlando Division against his former wife alleging that she breached her duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Dec. 30, 2014, he suffered damages upon discovery that his children from his marriage with the defendant were taken into the United States without his prior knowledge or consent. Moreover, the children and the defendant, as well as her boyfriend, are all presently in the United States illegally, as their tourist visas have expired. The plaintiff holds his ex-wife responsible because she allegedly violated his rights to shared custody of their children, removed the children from their habitual residence without his consent and obtained initial travel visas through fraudulent actions.

The plaintiff requests a trial by jury and seeks judgment against defendant, temporary restraining order, expenses, costs including transportation and further relief as may be just. He is represented by Stephanie Paige Cawein of Law Office of Stephanie P. Cawein PA in Fort Lauderdale.
