TAMPA – A woman alleges she is still disabled and that her long-term disability benefits were unlawfully terminated.
Dawn Mailles filed a complaint on Jan. 23 in the U.S. District Court for the Middle District of Florida against Metropolitan Life Insurance Co. and Micro Matic USA Inc. citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in October 2014, she became disabled and was initially approved to receive disability benefits until her claim was denied in March 2016. The plaintiff holds Metropolitan Life Insurance Co. and Micro Matic USA Inc. responsible because the defendants allegedly claimed that the plaintiff did not meet the definition of disability and terminated her disability benefits.
The plaintiff seeks declaration that she is entitled to long-term disability benefits, award benefits not paid to the plaintiff for a total of $18,647.20 plus interest, all legal fees and any other relief as the court deems just. She is represented by William C. Demas and John V. Tucker of Tucker & Ludin P.A. in St. Petersburg.
