MIAMI – An Arizona man and a North Carolina woman have filed a class-action suit against Bed Bath & Beyond over allegations a brand of bed sheets sold at the store are falsely labeled.

Donald Blair and Debbie Holland filed a complaint on behalf of all others similarly situated on Jan. 24 in the U.S. District Court for the Southern District of Florida against Bed Bath & Beyond Inc. alleging breach of express warranty, negligent misrepresentation and other counts.

According to the complaint, the plaintiffs allege that they suffered damages from purchasing a Welspun India product that they believed was made out of 100 percent Egyptian cotton at the defendant's store, but were actually made of inferior cotton. The plaintiffs hold Bed Bath & Beyond Inc. responsible because the defendant allegedly deceived consumers into overpaying for an inferior product.

The plaintiffs request a trial by jury and seek restitution, damages, statutory and punitive damages, disgorgement, interest, all legal fees and any other relief as the court deems just. They are represented by Edward H. Zebersky and Todd S. Payne of Zebersky Payne LLP in Fort Lauderdale and Robert B. Carey and Leonard W. Aragon of Hagens Berman Sobol Shapiro LLP in Phoenix.
