TAMPA – A Lithia resident and nurse alleges her insurer has filed to make a timely decision regarding her appeal for the termination of her disability benefits.
Kristen Reiter filed a complaint on Jan. 23 in the Tampa Division of the Middle District of Florida against The Lincoln National Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2013, she became disabled due to having complex regional pain syndrome and was initially approved to receive disability benefits, but the benefits were terminated in 2016. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly failed to make a decision regarding plaintiff's appeal for her disability benefits.
The plaintiff seeks declaration that the she is entitled to long-term disability benefits, benefits not paid to the plaintiff for a total of $24,804 plus interest, all legal fees and any other relief as the court deems just. She is represented by John V. Tucker and Amy Ray of Tucker & Ludin P.A. in St. Petersburg.
