Woman claims debt collector continued to contact her after alleged debt was discharged

TAMPA – A Hillsborough County consumer alleges a debt collector and a debt owner continued to contact her after the alleged debt was discharged in a bankruptcy.

Yamely Guerrero filed a complaint on Jan. 19 in the Tampa Division of the Middle District of Florida against OB Hospitalist Group LLC and Amerifinancial Solutions LLC citing the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in March 2016, she suffered damages from being sent collection letters from the defendants despite having a discharge order from the court. The plaintiff holds OB Hospitalist Group LLC and Amerifinancial Solutions LLC responsible because the defendants allegedly kept on calling and mailing letters to the plaintiff despite already filing for bankruptcy.

The plaintiff requests a trial by jury and seeks statutory damages, actual damages, punitive damages, all legal fees and any other relief as the court deems just. She is represented by Michael A. Ziegler of Law Office of Michael A. Ziegler PL in Clearwater.
