TAMPA – A Tampa business that sells sleep apnea services and programs alleges its SleepMaster Solutions mark is unlawfully being used.
Pharmacy Value Management Solutions Inc. filed a complaint on Jan. 19 in the Tampa Division of the Middle District of Florida against John Hartman, Nicole Flora M.D., SleepMaster Solutions Inc. alleging false designation of origin, false advertising, trademark infringement and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Hartman, Flora, SleepMaster Solutions Inc. and Dicentra responsible because the defendants allegedly solicited plaintiff's customers and sold sleep apnea services under the same trademark being used by the plaintiff.
The plaintiff seeks enjoin the defendant from further infringing plaintiff's marks, order to deliver up for destruction all infringing products, actual damages, profits, all legal fees and any other relief as the court deems just.
