Former BB Locksmith employees allege they were not paid overtime

FORT MYERS – Three Collier County residents allege their former Naples employer did not compensate them for overtime work and have filed a class action.

Mark Losey, Susan Nelson and Gary Dickson filed a complaint individually and on behalf of all others similarly situated on Jan. 17 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against BB Locksmith Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without being paid any overtime compensation. The plaintiffs holds BB Locksmith Inc. responsible because the defendant allegedly failed to pay the plaintiffs any overtime premiums at a rate of time-and-one-half for hours worked that exceeded 40 and failed to maintain time records.

The plaintiffs request a trial by jury and seek damages of overtime compensation, liquidated damages, all legal fees plus interest and any other relief as the court deems just. They are represented by Marcus W. Viles of Viles & Beckman LLC in Fort Myers.
