Woman seeks reinstatement to long-term disability benefits

MIAMI – A former Sears Holding Corp. employee claims she is still disabled and was wrongfully terminated from receiving long-term disability benefits.

Melissa Murphy filed a complaint on Jan. 6 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled and applied for disability benefits but her claim was denied by the defendant on March 5, 2014. That denial was overturned in October 2014, the suit states, then the defendant terminated her benefits in September 2015. The plaintiff holds Life Insurance Co. of North America responsible because the plaintiff alleges she is still entitled to those benefits and that the defendant failed to properly and adequately investigate her claim.

The plaintiff seeks payment of disability benefits, reinstatement, all legal fees plus interest and any other relief as this court deems just. She is represented by Stephen F. Jessup of Attorneys Dell and Schaefer, Chartered in Hollywood.
