MIAMI – A Miami-Dade County man alleges he worked 65 hours per week for his former employer and was only paid straight time for his overtime work.
Edwin Pena filed a complaint on behalf of all others similarly situated on Jan. 4 in the U.S. District Court for the Southern District of Florida against Tekton Construction Corp. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week from February 2015 to October 2016 without being paid proper overtime compensation. The plaintiff holds Tekton Construction Corp. responsible because the defendant allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for working more than 40 hours per week.
The plaintiff requests a trial by jury and seeks all overtime wages, liquidated damages, all legal fees plus interest and any other relief as the court deems just. He is represented by Jonathan S. Minick of Jonathan S. Minick P.A. in Miami.
