JACKSONVILLE – Two Jacksonville corporations claim businesses they partnered with to provide health services breached their contract.
Blue Cross and Blue Shield of Florida Inc. and Health Options Inc. filed a complaint on Dec. 22 in the Duval Circuit Court against Evolution Health LLC and Envision Healthcare Holdings Inc. alleging breach of contract.
According to the complaint, the plaintiffs allege that on Sept. 21, 2015, the plaintiffs entered into an agreement with Evolution, wherein Envision agreed to guarantee the financial performance of Evolution. Under agreement, the suit states Evolution was to provide care services and mobile health care services for plaintiffs, additionally, both parties agreed to maintain a Medical Expense Fund in the amount of $15 million to pay claims. The suit states the plaintiffs have drawn down $7 million of that fund to pay claims to providers, however, Evolution Health refused to replenish the balance of the reserve. The plaintiffs hold Evolution Health LLC and Envision Healthcare Holdings Inc. responsible because the defendants allegedly failed and refused to replenish the reserve, and failed to fulfill its obligation under the agreement.
The plaintiffs request a trial by jury and seek judgment against defendants, declaratory relief for defendants to replenish and maintain the $15 million balance of the reserve, incidental damages, interest, costs and further relief as the court may deem just.
