FLORIDA — A former employee is suing Pardo's Grill Cafe Inc. d/b/a Ceviche 7 Mares Peruvian Food, and Eulogio Emiliano Benitez Fernandez, employer, citing alleged unpaid wages and violation of workers compensation acts.
Hiverson Scott Simmons Sarango filed a complaint on Dec. 16, in the U.S. District Court for the Southern District of Florida against the defendants alleging that they failed to pay fair wages to the plaintiff.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation. The plaintiff holds Pardo's Grill Cafe Inc. d/b/a Ceviche 7 Mares Peruvian Food, and Eulogio Emiliano Benitez Fernandez responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week.
The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, interest, all legal fees and any other relief as this court deems just. He is represented by Brian H. Pollock of Fairlaw Firm in Miami.
