Employee alleges Florida company failed to pay overtime

FORT LAUDERDALE — A Broward County man is suing a Florida company, alleging unpaid wages and violation of workers compensation acts.

Henry Simmons Jr. filed a class action complaint, individually and on behalf of all others similarly situated, Dec. 16 in U.S. District Court for the Southern District of Florida Fort Lauderdale Division against B&B Contracting, Inc., Walter Beaton, and Robert Bazzano, alleging they failed to pay fair wages as required by the Fair Labor Standards Act.

According to the complaint, Simmons worked for the defendants between Dec. 15, 2013, and Oct. 23, 2016, an average of 50-55 40 hours per week being paid any overtime compensation. The plaintiff alleges the defendants failed to pay any time and half overtime premium for working more than 40 hours per week as required by FLSA.

Simmons seeks trial by jury, compensatory and liquidated damages, all legal fees and interest, plus all other relief the court deems just. He is represented by attorneys Daniel T.
