Medical Management International Inc. alleged to have violated TCPA

MIAMI – A Hollywood resident claims an Oregon pet health care company continued to call him after he asked it to stop.

David Abellard Jr. filed a complaint on Dec. 12 in the U.S. District Court for the Southern District of Florida against Medical Management International Inc., doing business as Banfield Pet Hospital, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he enrolled in a plan with the defendant in November 2015. The suit states that after receiving a call from representative, he terminated the plan, but the defendant allegedly continued its calls. The plaintiff holds Medical Management International, Inc. responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiff and continued to call after he revoked his consent in August and in September.

The plaintiff requests a trial by jury and seeks enjoin the defendant, statutory damages of $500, treble damages, all legal fees and any other relief as the court deems just. He is represented by Paul Alexander Bravo of P.A. Bravo, P.A. in Coral Gables.
