MIAMI — A Texas corporation is suing Michael's Auto Sales Corp. and car dealer Michael Nunez, with counts against the company and/or Nunez alleging breach of settlement agreement, breach of dealer agreement, fraud in the inducement and fraudulent suppressions and omissions.
Exeter Finance Corp. filed a complaint on Dec. 12 in the U.S. District Court for the Southern District of Florida against the defendants alleging that they failed to make a payment to the plaintiff based on a settlement agreement.
According to the complaint, the plaintiff alleges that Exeter Finance Corp. suffered monetary damages to its business. The plaintiff holds Michael's Auto Sales, Corp., and Michael Nunez responsible because the defendants allegedly made fraudulent misrepresentations and failed to make a payment when due.
The plaintiff seeks judgment against the defendants in the amount of $36,450, exemplary damages, all legal fees and any other relief as this court deems just. It is represented by Jonathan C. Brown and Sara L. Solano of Burr & Forman LLP in Fort Lauderdale.
