TAMPA – A Sarasota County man claims a debt collector continues to call him to collect fees he alleges were refunded.
Christopher Anzalone filed a complaint on Dec. 2 in the Tampa Division for the Middle District of Florida against EdFinancial Services LLC citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that in November 2015, he received a letter from ITT Educational Services that his debt to the school had been refunded. He alleges the defendant has called numerous times to collect a debt despite the plaintiff owing nothing and has also sent letters. The plaintiff holds EdFinancial Services LLC responsible because the defendant called and left messages to plaintiff with such frequency meant to abuse or harass, unlawfully utilized an automatic dialer and automated voice, and contacted plaintiff without prior express consent.
The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages, actual damages, attorney's fees, costs, and other such relief the court may deem proper. He is represented by Aaron M. Swift of Leaven Law in St. Petersburg.
