Key Biscayne Mechanical Inc. alleged to owe contributions

MIAMI – Several labor union groups allege a Miami business is behind on paying employee contributions.

MCASF Local 725 Service Corp., for and on behalf of The ACRA-Local 725 Pension Trust Fund, et al. filed a complaint on Dec. 9 in the U.S. District Court for the Southern District of Florida against Key Biscayne Mechanical Inc. citing the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid fringe contributions from the defendant. The plaintiffs hold Key Biscayne Mechanical Inc. responsible because the defendant allegedly breached its agreement with the labor group by failing to remit its contributions on behalf of its employees.

The plaintiffs seek for the defendant to allow an audit of its payroll books and records and pay for the costs of the audit, damages, all legal fees plus interest and liquidated damages, plus any other relief as the court deems just. They are represented by Richard M. Weiner of Richard M. Weiner, P.A. in Plantation.
