Customer accuses Aetna of failing to pay proper benefits

JACKSONVILLE — A Davie County woman is suing Aetna, alleging violation of the Employment Retirement Income Security Act (ERISA).

Sharifa Williams filed a lawsuit Dec. 1 in U.S. District Court for the Middle District of Florida Jacksonville Division against Aetna Life Insurance Company, alleging non-payment of plan benefits.

According to the complaint, on July 8, 2014, Williams became entitled to long-term disability benefits as a result of disabling medical conditions. Aetna, however, the suit says, has denied any payment of benefits under the terms of plan due to Williams.

The lawsuit states Williams has exhausted any and all administrative remedies pursuant to the plan, causing her monetary damages. 

The plaintiff alleges Aetna has failed to fulfill its obligations under the insurance plan, by failing to pay the rightful benefits, causing Williams to retain and pay for counsel fees.

Williams seeks trial by jury, judgment for payment of long-term disability benefits due, plus interest, costs and attorney fees. She is represented by attorney Thomas M. Farrell of Farrell Disability Law in Jacksonville.
