West Way Towing of Palm Beach Inc. accused of wrongfully terminating man while on medical leave

MIAMI – A manager alleges he was unlawfully terminated by his employer while he was on medical leave.

Pat Elia filed a complaint on Dec. 7 in the U.S. District Court for the Southern District of Florida against West Way Towing of Palm Beach Inc. citing the Family & Medical Leave Act and retaliation.

According to the complaint, the plaintiff alleges that in 2014, he was diagnosed with scarred lungs and requested time off in May to recover since the defendant informed him no light duty work was available. He alleges he was terminated by the defendant two days into his leave. The plaintiff holds West Way Towing of Palm Beach Inc. responsible because the defendant allegedly failed to provide the plaintiff any FMLA protected leave.

The plaintiff requests a trial by jury and seeks all damages, all legal fees and any other relief as the court deems just. He is represented by Chad Levy of Law Offices of Levy & Levy P.A. in Fort Lauderdale.
