TAMPA – A Pinellas County man alleges his former Largo HVAC contractor employer did not pay him overtime wages.
Philip Plantz filed a complaint on Nov. 30 in the Tampa Division for the Middle District of Florida against Bay Area Heating and Cooling Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that in January 2015, he started working for the defendant as a non-exempt service technician and that he routinely worked on-call shifts outside of his normal work schedule. As a result, the plaintiff allegedly regularly worked in excess of 40 hours per week but did not receive overtime compensation at a proper rate for those hours. The plaintiff holds Bay Area Heating and Cooling Inc. responsible because the defendant allegedly failed to pay plaintiff for overtime compensation, failed to maintain proper time records of all hours worked, and failed to post informational posters as required by law advising its employees of their rights under FLSA.
The plaintiff requests a trial by jury and seeks judgment in its favor, award unpaid overtime wages, liquidated damages, interest, attorney's fees and costs, expenses of litigation, and further relief as the court deems just.
