Consumer claims collection letter from Mercantile Adjustment Bureau was misleading

MIAMI – A Miami-Dade County man alleges a debt collector mailed him a misleading letter.

Marcus D. Mims filed a complaint on Dec. 2 in the U.S. District Court for the Southern District of Florida against Mercantile Adjustment Bureau LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in April 2016, the defendant mailed him a collection letter regarding a defaulted retail installment sales contract. The suit states that the letter stated that the current debt is $14,240.35 but that the plaintiff could resolve the debt for $7,262.57. The plaintiff holds Mercantile Adjustment Bureau LLC responsible because the defendant allegedly failed to state in the letter that resolving the account with the $7,262.57 payment would result in a derogatory status and that the difference between the prices would be reported to the Internal Revenue Service as income.

The plaintiff requests a trial by jury and seeks damages, all legal fees and any other relief as the court deems just. He is represented by Donald A. Yarbrough in Fort Lauderdale.
