Bluestem Brands alleged to have harassed consumer with telephone calls

ORLANDO – A Brevard County man alleges a debt collector has called him hundreds of times.

Richmond Johnson filed a complaint on Nov. 21 in the U.S. District Court for the Middle District of Florida, Orlando Division against Bluestem Brands Inc., doing business as Fingerhut, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he received calls from the defendant approximately 500 times in its attempt to collect a consumer debt since he asked the defendant to cease calling him in September 2015. The plaintiff holds Bluestem Brands Inc. responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory, punitive and actual damages, costs, interest, attorney's fees, enjoinder from further violations and other such relief the court may deem just. He is represented by Amy Ferrera of Morgan & Morgan in Tampa.
