MIAMI – An Indian River County man alleges a Connecticut-based debt collector called him without identifying itself.
James Alderman filed a complaint on behalf of himself and all others similarly situated on Nov. 28 in the U.S. District Court for the Southern District of Florida against Genpact Services LLC alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, the plaintiffs allege that in April 2016, he received three calls from the defendant seeking to collect an allegedly delinquent credit card debt. The plaintiff claims that none of the messages identified that the call was from a debt collector. The plaintiffs hold Genpact Services LLC responsible because the defendant allegedly misleadingly omitted that the messages were from a debt collector.
The plaintiff requests a trial by jury and seeks judgment in his favor, certify case as a class action, appoint class representative and class counsel, statutory damages, attorney’s fees, litigation expenses, costs of suit and further relief as the court deems proper.
