Miami souvenir company accuses competitor of copyright infringement

MIAMI — A Miami souvenir company is suing a Florida competitor, alleging copyright infringement.

American Gift Corporation filed a lawsuit Dec. 1 in U.S. District Court for the Southern District of Florida against KB Howell Enterprises, LLC, doing business as Beachcombers Coastal Life, alleging the defendant made a product confusingly similar to plaintiff's product.

According to the complaint, American Gift, a leading source of souvenir and gift products since 1925, suffered monetary damages to its business because the defendant reproduced and publicly displayed unauthorized copies of the plaintiff's artwork.

American Gift seeks immediate cease and desist orders from using its art, enjoin the defendant from further infringing the plaintiff's product, damages, statutory damages not less than three times damages awarded, legal fees and all relief the court deems just.
