Former No Pressure Roof Cleaning employee claims he was not paid overtime

WEST PALM BEACH – A Loxahatchee employer is accused of wrongfully classifying its employees as independent contractors.

Christian Espinoza filed a complaint on behalf of all others similarly situated on Nov. 30 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against No Pressure Roof Cleaning LLC and Paul Guitard citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation because he was classified as an independent contractor. The plaintiff holds No Pressure Roof Cleaning, LLC and Guitard responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half.

The plaintiff requests a trial by jury and seeks all unpaid overtime wages, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Joseph Odato and Dennis A. Creed III of Creed & Pinkard PLLC in Tampa.
