Illinois corporation accuses Florida resident of trademark infringement

FORT PIERCE — An Illinois corporation is suing a Florida man, alleging he illegally advertises the services of the plaintiff. 

The Society of Actuaries in Schaumburg, Illinois, filed a lawsuit Nov. 30 in U.S. District Court for the Southern District of Florida Fort Pierce Division against Gerald Reiss of Port St. Lucie, Florida, alleging unfair competition.

According to the complaint, the Society of Actuaries, the largest actuarial professional organization worldwide, suffered monetary damages because Reiss used the plaintiff's trademark to mislead consumers that they associated with the society's ASA (Associate of the Society of Actuaries) trademark.

The Society of Actuaries seeks to enjoin Reiss from further infringing the plaintiff's trademark, the destruction of all infringing materials, pay the plaintiff for all profits and damages, treble damages, all legal fees and interest, plus all other relief the court deems just. It is represented by attorneys Robert Alfert, Jr. and Edward R. Philpot of Broad and Cassel in Orlando, and by Anne E. Naffziger and Michelle L. Zimmermann of Leydig, Voit & Mayer Ltd. in Walnut Creek, California.
