MetLife accuses client of unjust enrichment

TAMPA — Metropolitan Life is suing a Pinellas County man, alleging unjust enrichment in hiding pertinent facts about his medical history.

Metropolitan Life Insurance Company filed a lawsuit Nov. 23 in U.S. District Court for the Middle District of Florida Tampa Division against Adam Bressler, alleging fraudulent omissions and/or misrepresentations.

According to the complaint, on Nov. 25, 2007, MetLife started to provide Bressler with insurance policy coverage with benefits of approximately $10,000 per month in the event of total disability. Consequently, the suit says, MetLife discovered Bressler concealed facts in response to questions on the application and in a personal history interview.

The lawsuit states Bressler refused to disclose facts including admission to a treatment center for addiction to pain medication, alcohol abuse, a diagnosis of attention deficit disorder and a history of prescriptions for multiple anti-depressants, 

Because of the defendant's misrepresentations and omissions, the lawsuit says, MetLife has issued a policy and paid disability benefits to which the plaintiff was not entitled to as no valid policy existed. 

The plaintiff alleges Bressler failed to advise MetLife of his true and accurate medical history and condition, and concealed facts to persuade the plaintiff to issue insurance coverage.

Metropolitan Life Insurance seeks trial by jury, an order rescinding the policy, compensatory damages, a return of disability benefits, plus prejudgment interest, court costs and all further relief the court deems just. It is represented by attorneys John E. Meagher and Jeffrey M. Landau of Shutts & Bowen LLP in Miami.
