Couple alleges Paypal Credit contacted them instead of lawyer as instructed

TAMPA – A Hillsborough County couple alleges a debt collector unlawfully contacted them after consent was revoked.

Jennifer and Jason McCambridge filed a complaint on Nov. 25 in the Tampa Division of the Middle District of Florida against Paypal Credit Inc. alleging violation of the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that on Jan. 14, 2016, Jennifer McCambridge revoked any prior express consent for defendant to contact her via cellphone or any other form of communication and to contact her attorney instead. She alleges that despite her demands, the defendant continued to call or send correspondence to discuss her bill and also called Jason McCambridge, who was not a party to the subject account and did not owe the alleged debt.

The plaintiffs hold Paypal Credit Inc. responsible because the defendant allegedly engaged in an unlawful practice of using an autodialer and/or artificial voice to place calls to cellular phones and without prior express consent to place the calls.

The plaintiffs request a trial by jury and seek judgment against defendant, actual and statutory damages, injunctive relief, costs of action, attorney’s fees and other relief the court deems just. They are represented by Christopher W. Boss of Boss Law in St. Petersburg.
