Capital One Bank accused of violating telephone law

DUVAL, Florida — A consumer is suing Capital One Bank, N.A., a debt collector, citing alleged violation of telephone harassment statutes.

George Hoffer filed a complaint on Nov. 28 in the Fourth Judicial Circuit Court against Capital One Bank, N.A. claiming that the debt collector called the plaintiff several times in an attempt to collect an alleged debt.

According to the complaint, the plaintiff alleges that in 2016, he suffered damages from receiving several collection calls. The plaintiff holds Capital One Bank, N.A. responsible because the defendant allegedly used automatic telephone dialing equipment to contact the plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages, a permanent injunction, all legal fees and any other relief as this court deems just. He is represented by Max Story of Max Hunter Story, P.A. in Jacksonville Beach.
