PALM BEACH – A Palm Beach County man alleges a Houston business sent him unsolicited text messages.
Matthew Gottlieb filed a complaint on behalf of all others similarly situated on Nov. 23 in the U.S. District Court for the Southern District of Florida, Palm Beach Division against Citgo Petroleum Corp. alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that he received telemarketing text messages from the defendant despite being registered to the Do Not Call Registry. The plaintiff holds Citgo Petroleum Corp. responsible because the defendant allegedly sent unsolicited text messages to the plaintiff's cellular telephone without his consent.
The plaintiff requests a trial by jury and seeks injunctive relief against the defendant, statutory damages of $500 for each and every text message made, and any other relief as the court deems just.
