MIAMI – A consumer alleges a debt collector has been unlawfully contacting her.
Rose Cherubin filed a complaint on Nov. 23 in the U.S. District Court for the Southern District of Florida against Ocwen Loan Servicing LLC alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that in 2016, she suffered damages from receiving hundreds of collection calls from the defendant in an attempt to collect an alleged debt. The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiff and called her without her consent.
The plaintiff requests a trial by jury and seeks statutory damages of $1,500 for each and every violation, to enjoin the defendant, and any other relief as the court deems just. She is represented by George N. Andrews of Loan Lawyers LLC in Fort Lauderdale.
